Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Suzhou Maifangbao Tech Ltd. (“we”, “us”), the operator of PennyVid (pennyvid.com, the “Service”). By signing in to or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

PennyVid is an AI tool that turns a topic or script you provide into a short video, using AI-written scripts, AI voiceover, stock photos, images you upload, background music and automatically generated subtitles. Output is produced automatically and may contain errors, inaccuracies or content you did not expect. You are responsible for reviewing every script and video before you use it.

2. Accounts

You sign in with a Google account. You must be at least 13 years old (or the minimum age required in your country) to use the Service. You are responsible for all activity under your account and for keeping access to it secure.

3. Credits

Generating scripts and videos consumes credits, as shown in the Service. Credits for a failed generation are refunded automatically. Credits have no cash value, cannot be transferred, and may be changed or discontinued by us. We may change pricing and plan features at any time; changes do not affect credits already spent.

4. 30-day storage

Generated videos, and the files used to make them (including images you upload and voiceover audio), are stored for 30 days from the time the video is created, and are then permanently and automatically deleted. Deleted videos and files cannot be recovered. PennyVid is not a storage or backup service — download anything you want to keep before it expires. We are not liable for any loss caused by this deletion.

5. Personal, non-commercial use only

Videos generated with the Service are licensed to you for personal, non-commercial use only. Without our prior written permission you may not use generated videos, or any part of them (including the voiceover, stock photos and music), for commercial purposes — for example advertising, marketing or promoting a product, service or business; selling or licensing the video; or monetized content made on behalf of a business.

Generated videos contain third-party material (such as stock photos and music) that is subject to its own license terms. If you use a generated video commercially or otherwise outside these Terms, you do so entirely at your own risk and you alone are responsible for any resulting claims, disputes, losses, fines or other consequences, including copyright, trademark, publicity and platform-policy claims. We accept no liability for such use.

6. Your content and responsibility

You keep whatever rights you have in the topics, scripts and images you submit (“Your Content”). You confirm that you have the rights needed to submit Your Content and that it does not infringe anyone else’s rights. You grant us a limited license to store, process and transmit Your Content solely to operate the Service for you.

PennyVid is only a tool. You decide what to create, and you are solely and fully responsible for Your Content and for every video you generate, publish or share. We do not pre-screen or endorse user content. If you deliberately or maliciously create illegal or harmful content, you alone bear all legal liability for it, and you agree to indemnify and hold harmless Suzhou Maifangbao Tech Ltd. and its staff from any claims, losses and costs (including reasonable legal fees) arising from your content or your breach of these Terms.

7. Prohibited use

You must not use the Service to create, upload or distribute content that:

• is illegal under the laws that apply to you or to us;
• sexually exploits or endangers minors, or is pornographic or obscene;
• promotes terrorism, violence, self-harm, hatred or discrimination;
• is fraudulent or deceptive, including scams, impersonation and misleading deepfakes of real people;
• defames, harasses or threatens anyone, or discloses another person’s private information;
• infringes copyrights, trademarks or other intellectual-property or privacy rights;
• is spam or malware, or attempts to disrupt, overload, reverse-engineer or abuse the Service or its credits.

We may remove content, suspend or terminate accounts, forfeit credits, and report activity to the authorities when we reasonably believe these Terms or the law have been broken, with or without notice.

8. Our rights

The Service, its software, design and branding belong to Suzhou Maifangbao Tech Ltd. and its licensors. Videos on the free plan carry a PennyVid watermark, which you must not remove or obscure.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that generated content will be accurate, lawful for your purpose or free of third-party rights.

10. Limitation of liability

To the maximum extent permitted by law, Suzhou Maifangbao Tech Ltd. is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, content, profits or revenue. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose, or USD 10 if you have paid nothing.

11. Termination

You may stop using the Service at any time. We may suspend or end your access at any time if you breach these Terms or if we discontinue the Service. Sections 5, 6, 9, 10 and 12 survive termination.

12. Changes and governing law

We may update these Terms from time to time; the date above shows the latest version, and continued use of the Service after a change means you accept it. These Terms are governed by the laws of the People’s Republic of China. Any dispute shall be submitted to the competent court where Suzhou Maifangbao Tech Ltd. is located.
